Following a trial to the court without a jury, Stanley De Carlos Jones was convicted on April 17, 1970, under sec. 943.32 (1) (b) and (2), Stats., of armed robbery and sentenced to an indeterminate term of not more than twenty years, the sentence to run concurrently with a sentence Jones was then serving. About a year later on April 14, 1971, Jones moved to vacate the judgment and to make a finding of not guilty notwithstanding the verdict and for a new trial on the ground that a pretrial out-of-court identification of Jones by a witness had been made under unduly suggestive circumstances and tainted the in-court identification. The court, after conducting a Wade hearing, denied the motion. Writs of error were issued on September 14, 1971, to review the judgment of conviction and the order denying the motion.
